By claiming that “just war is just war,” critics suggest that just war theory both distracts from and sanitizes the horror of modern warfare by dressing it up in the language of moral principles. However, the phrase can also be taken as a reminder of why we need just war theory in the first place. It is precisely because just war is just war, with all that this implies, that we must think so carefully and so judiciously about it. Of (...) course, one could argue that the rump of just war scholarship over the past decade has been characterized by disinterest regarding the material realities of warfare. But is this still the case? This essay examines a series of benchmark books on the ethics of war published over the past year. All three exemplify an effort to grapple with the hard facts of modern violent conflict, and they all skillfully bring diverse traditions of just war thinking into conversation with one another. James Turner Johnson is the foremost scholar of the just war tradition working today. His treatment of the historical development of the just war tradition has been hugely important, influencing a generation of theorists. Despite this, Johnson's work has not generated much in the way of critical commentary or analysis. This paper aims to rectify this oversight. Engaging in a close and critical reading of Johnson's work, it claims that his historical reconstruction of the just war tradition is bounded by (...) two key thematic lines — the imperative of vindicative justice and the ideal of Christian love — and occasionally betrays an excessive deference to the authority of past practice. By way of conclusion, this paper sums up the promise and limits of Johnson's approach, and reflects upon its contribution to contemporary just war scholarship. (shrink)

This paper raises concerns about the tenor of 21st century interaction by identifying a tendency whereby relatively innocuous, canonically private communication is transformed into public communication deemed offensive enough to attract institutional or legal sanction. To understand examples of this tendency, it applies Goffman’s architecture of interaction to email communication and proposes the notion of situational transformation to encapsulate reframing processes involving footing, face and participation framework. Through these processes (to which, it is shown, the email medium is especially vulnerable) (...) and a discourse of civility, the private becomes public and opposition becomes offence. (shrink)

The year 2020 has been a very trying one for many people, and universities have not been exempted from the challenges it has posed. There are real concerns that the effects of COVID-19 could lead to a lost generation of academic researchers. At the same time, this has been an unusually fecund period for the field of ethics and international affairs. New ideas regarding the relationship between politics and ethics have come to light, with implications for how we think about (...) what ethics actually comprises. This essay seeks to take stock of this moment by considering the contributions to the field made by four recently published books. It concludes that we are observing a trend toward a more expansive way of thinking about ethics, one that has significant implications for how we approach the task of international relations scholarship. Drawing on Isaiah Berlin's celebrated essay on Tolstoy, this paper poses the question should James Turner Johnson be deemed a hedgehog or a fox? That is, it considers whether Johnson should be regarded as a monist (hedgehog) or a pluralist (fox) in his contribution to the just war tradition. It contends that his commitment to history, while superficially indicative of a hedgehog, serves to conceal a deep-lying pluralism ? or at least the possibility of such ? in his views on (...) the meaning of history. Contrary to initial appearances, then, Johnson's commitment to history is not univocal: it does not speak with one voice, and to one purpose. Rather it suggests a variety of voices or positions, and is amenable to multiple interpretations, not all of which are of a piece with one another. This paper seeks to uncover these various voices or positions, with a view to raising some searching questions pertaining to how we should properly understand the just war tradition today. (shrink)

Among the most vexed moral issues in contemporary conflict is the matter of whether irregular forces waging wars of national liberation should be expected to abide by the same jus in bello rules as state actors, even though these rules may prejudice their cause. Is it, in other words, reasonable to demand that irregular forces, including guerrilla groups and national liberation movements, should comport themselves like state armies, even in cases where this would stymie their capacity to effectively pursue their (...) military goals? This article examines Michael Gross’s recent provocative response to this question. Taking Article 44 of the 1977 Additional Protocol I to the Geneva Conventions as his point of departure, Gross contends that the laws governing battlefield conduct should be revised to allow irregular forces waging an otherwise just war greater leeway to pursue their cause. Controversially, he extends this concession to the use of qualified terrorist tactics. Focusing on Gross’s use of the notion of a ‘right to a fighting chance’ as a normative grounding for this far-reaching proposition, this article draws on specific historical cases that arose in the context of Ancient Greek warfare to challenge Gross’s position. On a broader note, this article concludes with some remarks to the effect that this foray into the world of Ancient Greek warfare is demonstrative of the critical potential of a historical approach to the ethics of war. Nigel Biggar’s In Defence of War delivers a stout defence of just war thinking. It refuses to shy away from the tough questions raised by modern warfare. Instead, it submits that thinking clearly about these questions may require just war scholars to demonstrate a toughness to match, by callousing themselves to the human suffering their vocation forces them to confront. This article seeks to tease out Biggar’s understanding of callousness, challenging the reader to consider what is lost and enabled by (...) it. It concludes that Biggar offers a revealing account of callousness in war, but leaves us with many searching questions. Is callousness a vice or virtue, and is it an Achilles heel or a basic prerequisite of just war thinking? (shrink)

This book comprises essays that focus on a range of thinkers that challenge the boundaries of the just war tradition. The ethics of war scholarship has become a rigid and highly disciplined activity, closely associated with a very particular canon of thinkers. This volume moves beyond this by presenting thinkers not typically regarded as part of that canon, but who have interesting and potentially important things to say about the ethics of war. The book presents twenty profile essays on an (...) eclectic cast of heretics, humanists, and radicals, from Epictetus to Rosa Luxemburg to Frantz Fanon and Judith Butler. The book asks whether there is a good reason for the marginalisation of these thinkers and what ethics of war scholars might benefit from engaging with them. Some of these thinkers engage directly with-to augment or criticise-the just war tradition, while others contribute to military thinking across the ages and push the boundaries of what was acceptable in war. Many proffer alternative moral frameworks regarding the legitimacy of political violence. The present volume thus invites scholars to reconsider the ethics of war in a way that challenges the standard delineation between just war theory, realism, and pacifism, and to reflect on how those positions might inform our own approach to these matters. Plato wrote in theRepublicthat quarrels between fellow countrymen are wont to be more virulent and nasty than those between external enemies. Sigmund Freud have similarly cautioned of the malice and excess that can attend conflicts that are fuelled not by antithetical oppositions, but by the “narcissism of minor difference.” Bearing these warnings in mind, scholars of the ethics of war would be well advised to consider the implications of James Turner Johnson's acute observation in his contribution to this special section (...) ofEthics & International Affairsthat their field of study is currently beset not so much by external opposition as by divisions within the ranks. The principal antagonism within the field, at least as I understand it, is the rift that has emerged between what I shall call historical and analytical approaches to the subject. Laying my cards on the table, the work that I have done in the past connects more clearly with the former than the latter. However, it has struck me, as it must have struck others, that the historical approach has in recent years come to assume a rather scuffed and unfashionable, evenoutré, appearance. It has been the subject of numerous curt dismissals, but has also, more interestingly, been tarnished by a few powerful critiques. This article will elucidate four of the most hard-hitting charges levied at the historical approach, and evaluate its continuing utility in light of them. The question then is: Have the critics of this approach landed it a knock-out blow, or can the historical approach withstand the bricks and bats that have been hurled its way? (shrink)

The False Claims Act, 31 U.S.C. § 3729, a post-Civil War law inspired by cases of defense contracting fraud, was revitalized in 1986. Since then it has been used to sue both manufacturers and providers of pharmaceuticals. In some cases, these suits were meant to target offlabel marketing of pharmaceuticals. In 2009, the 11th Circuit rendered a decision in Hopper v. Solvay Pharmaceuticals that dramatically limits the ability of private plaintiff whistle-blowers to bring qui tam suits under the FCA for (...) such marketing. In June 2010, the Supreme Court denied certiorari, making the Circuit court decision final. The Solvay decision creates a significant barrier to certain kinds of qui tam suits, requiring the plaintiff to demonstrate the intent to market off-label, including by showing specific prescriptions that were written as a result of efforts to do so. Moral Victories is the first book-length treatment of the ethical dimensions of victory in war.

In this study, we discuss the role of senior nurses who sit on clinical commissioning groups that now plan and procure most health services in England. These nurses are expected to bring a nursing view to all aspects of clinical commissioning group business. The role is a senior level appointment and requires experience of strategic commissioning. However, little is known about how nurses function in these roles. Following Barrientos' methodology, published policy and literature were analysed to investigate these roles and (...) National Health Service England's claim that nursing can influence and advance a nursing perspective in clinical commissioning groups. Drawing on work by Berg, Barry and Chandler on ‘new public management’, we discuss how nurses on clinical commissioning groups work at the alignment of the interests of biomedicine and managerialism. We propose that the way this nursing role is being implemented might paradoxically offer further evidence of the devaluing of nursing rather than the emergence of a strong professional nursing voice at the level of strategic commissioning. Prompted by the development of the Theory of Challenge and Threat States in Athletes (Jones et al, 2009), recent years has witnessed a considerable increase in research examining challenge and threat in sport. This manuscript provides a critical review of the literature examining challenge and threat in sport, tracing its historical development and some of the current empirical ambiguities. In an attempt to reconcile some of these ambiguities, and utilising neurobiological evidence associated with approach- and avoidance-motivation (cf. Elliot & Covington, (...) 2001), this paper draws upon the Evaluative Space Model (ESM: Cacioppo et al., 1997) and considers the implications for understanding challenge and threat in sport. For example, rather than see challenge and threat as opposite ends of a single bipolar continuum, the ESM implies that individuals could be (1) challenged, (2) threatened, (3) challenged and threatened, or (4) neither challenged or threatened by a particular stimulus. From this perspective it could be argued that the appraisal of some sport situations as both challenging and threatening could be advantageous, whereas the current literature seems to imply that the appraisal of stress as a threat is maladaptive for performance. In drawing upon the ESM, we outline the Evaluative Space Approach to Challenge and Threat and provide several testable hypotheses for advancing understanding of challenge and threat (in sport). We also outline a number of cardiovascular and experiential measures that can be used to examine these hypotheses. BackgroundThe pursuit of a cure for HIV is a high priority for researchers, funding agencies, governments and people living with HIV (PLWH). To date, over 250 biomedical studies worldwide are or have been related to discovering a safe, effective, and scalable HIV cure, most of which are early translational research and experimental medicine. As HIV cure research increases, it is critical to identify and address the ethical challenges posed by this research.MethodsWe conducted a scoping review of the growing HIV cure (...) research ethics literature, focusing on articles published in English peer-reviewed journals from 2013 to 2021. We extracted and summarized key developments in the ethics of HIV cure research. Twelve community advocates actively engaged in HIV cure research provided input on this summary and suggested areas warranting further ethical inquiry and foresight via email exchange and video conferencing.DiscussionDespite substantial scholarship related to the ethics of HIV cure research, additional attention should focus on emerging issues in six categories of ethical issues: (1) social value (ongoing and emerging biomedical research and scalability considerations); (2) scientific validity (study design issues, such as the use of analytical treatment interruptions and placebos); (3) fair selection of participants (equity and justice considerations); (4) favorable benefit/risk balance (early phase research, benefit-risk balance, risk perception, psychological risks, and pediatric research); (5) informed consent (attention to language, decision-making, informed consent processes and scientific uncertainty); and (6) respect for enrolled participants and community (perspectives of people living with HIV and affected communities and representation).ConclusionHIV cure research ethics has an unfinished agenda. Scientific research and bioethics should work in tandem to advance ethical HIV cure research. Because the science of HIV cure research will continue to rapidly advance, ethical considerations of the major themes we identified will need to be revisited and refined over time. (shrink)

We describe a formalization of asymptotic O notation using the Isabelle/HOL proof assistant.

Pragmatic language competence plays a central role in how aviation flight crews perform crew resource management ; this competence significantly affects aviation safety. This paper contributes to existing literature on interventionist applications of conversation analysis by defining and evaluating a novel collaborative transcription and repair based learning method for aviation CRM learning. CTRBL was evaluated using a quantitative quasi-­experimental repeated-measure design with 42 novice, university pilots. Results support that CTRBL is an effective, low-resource CRM learning method that will benefit from (...) exploratory applications and further study in pragmatics, aviation, and other sociotechnical domains. This case study describes the design, learning experiences, and student outcomes in one Instructional Design course with an explicit focus on globally competent teaching. We make the argument that forefronting global competence in an Instructional Design course, prior to social studies methods, is a necessary precursor to accelerate students’ progress on a pathway towards teaching for global competence. In support of this argument, we (a) describe the ways in which an Instructional Design course in one university forefronted global competence; (b) (...) explain the short- and long-term outcomes of this design; and (c) highlight four students to illustrate how the Instructional Design course helped to move students along a pathway towards global competence. Through a close re-examination of Eugene O'Neill's oeuvre, from minor plays to his Pulitzer-winning works, this study proposes that O'Neill's vision of tragedy privileges a particular emotional response over a more "rational" one among his audience members. In addition to offering a new paradigm through which to interpret O'Neill's work, this book argues that O'Neill's theory of tragedy is a robust account of the value of difficult theatre as a whole, with more explanatory scope and power than its cognitivist counterparts. (...) This paradigm reshapes our understanding of live theatrical tragedy's impact and significance for our lives. The book enters the discussion of tragic value by way of the plays of Eugene O'Neill, and through this study, Killian makes the case that O'Neill has refused to allow Plato to define the terms of tragedy's merit, as the cognitivists have. He argues that O'Neill's theory of tragedy is non-cognitive and locates the value of a play in its ability to trigger certain emotional responses from the audience. This would be of great interest to students and scholars of performance studies, literature and philosophy. (shrink)

From ancient times to the beginning of the nineteenth century, mathematics was commonly viewed as the general science of quantity, with two main branches: geometry, which deals with continuous quantities, and arithmetic, which deals with quantities that are discrete. Mathematical logic does not fit neatly into this taxonomy. In 1847, George Boole [1] offered an alternative characterization of the subject in order to make room for this new discipline: mathematics should be understood to include the use of any symbolic calculus (...) “whose laws of combination are known and general, and whose results admit of a consistent interpretation.” Depending on the laws chosen, symbols can just as well be used to represent propositions instead of quantities; in that way, one can consider calculations with propositions on par with more familiar arithmetic calculations. Despite Boole’s efforts, logic has always held an uncertain place in the mathematical community. This can partially be attributed to its youth; while number theory and geometry have their origins in antiquity, mathematical logic did not emerge as a recognizable discipline until the latter half of the nineteenth century, and so lacks the provenance and prestige of its elder companions. Furthermore, the nature of the subject matter serves to set it apart; as objects of mathematical study, formulas and proofs do not have the same character as groups, topological spaces, and measures. Even distinctly mathematical branches of contemporary logic, like model theory and set theory, tend to employ linguistic classifications and measures of complexity that are alien to other mathematical disciplines. The Birth of Model Theory, by Calixto Badesa, describes a seminal step in the emergence of logic as a mature mathematical discipline. As its title suggests, the focus is on one particular result, now referred to as the L¨owenheim-Skolem theorem, as presented in a paper by L¨owenheim in 1915. But the book is, more broadly, about the story of the logic community’s gradual coming to the modern distinction between syntax and semantics, that is, between systems of symbolic expressions and the meanings that can be assigned to them.. Liberal democracy seeks to harness state power to the causes of individual freedom and public benefit - through such means as constitutional limits on and separation of powers, free and regular elections, and the vigilance of citizens, parliaments and media. This collection of essays offers perspectives on the difficulties of establishing and sustaining (...) a modern liberal democratic state. These themes are pursued through subjects ranging from the extreme abuses of power by Nazi regime to the misuse of power by executive government in the "WA Inc" years, from the quest for a genuinely republican Australia to the role of trust and suspicion in liberal democracy, from the alleged decline of the state in a globalizing world to the construction of a new state in East Timor, and from the importance of free scholarship to the role of deliberative polling in enhancing the democratic process. The late Patrick O'Brien, scholar, teacher, public intellectual and political activist, believed passionately in the importance of personal liberty and in the firm and transparent regulation of the exercise of power.
